Some details of the petition filed on Monday by the Peoples Democratic Party and its presidential candidate in the February 23 election, Alhaji Atiku Abubakar, to challenge the victory of President Muhammadu Buhari and his All Progressives Congress, emerged on Tuesday.
The petition, which sought to rely on 50 sets of documents, was filed before the Presidential Election Petitions Tribunal in Abuja against the Independent National Electoral Commission, Buhari and the APC as the first to the third respondents, respectively.
INEC had on February 27, 2019 declared that Buhari won the election with 15,191,847 votes to defeat Atiku, whom it said polled 11,262,978 votes.
But the petitioners stated in their 139-page petition that “from the data in the 1st respondent’s (INEC’s) server…the true, actual and correct results” from “state to state computation” showed that Atiku polled a total of 18,356,732 votes to defeat Buhari whom they said scored 16,741,430 votes.
They said the results were the total votes scored by the candidates in 35 states and the Federal Capital Territory Abuja, as there was “no report on sever” about the results from Rivers State as of February 25, 2019.
By this, Atiku claims to have defeated Buhari with 1,615,302 votes.
One of the five grounds of the petition also tends to resuscitate the allegation that Buhari was not qualified to run for the office of the President on the grounds that he did not possess the constitutional minimum qualification of a school certificate.
The five grounds of the petition read, “The 2nd respondent (Buhari) was not duly elected by the majority of lawful votes cast at the election.
“The election of the 2nd respondent is invalid by reason of corrupt practices.
“The election of the 2nd Respondent is invalid by reason of non-compliance with the provisions of the Electoral Act, 2010 (as amended).
“The 2nd respondent was at the time of the election not qualified to contest the said election.
“The 2nd respondent submitted to the 1st Respondent an affidavit containing false information of a fundamental nature in aid of his qualification for the said election.”
Arguing that Buhari was not qualified to run for the office of the President, the petitioners argued in part, “The petitioners state that the 2nd respondent (Buhari) does not possess the educational qualification to contest the election to the office of the President of Federal Republic of Nigeria.
“The petitioners state that by Section 31 (1) of the Electoral Act, 2010 (as amended), every political party shall not later than 60 days before the date appointed for a general election submit to the Commission in the prescribed form the list of the candidates the party proposes to sponsor at the elections.
“Further, by Section 31(2) of the Electoral Act, 2010 (as amended), the list or information submitted by each candidate shall be accompanied by an affidavit sworn to by the candidate at the Federal High Court, High Court of a State or Federal Capital Territory indicating that he has fulfilled all the constitutional requirements for election into that office.
“The 2nd respondent filled and submitted Form CF001 to the 1st Respondent, which was declared before the Commissioner for Oaths at the Registry of the High Court of the Federal Capital Territory, Abuja on the 8th day of October, 2018. The said Form CF001 is accompanied by an ACKNOWLEDGEMENT indicating that the 1st Respondent received same.
“The petitioners aver that the said Form CF001 filled by the 2nd Respondent and submitted to the 1st Respondent for the Office of President was also accompanied by the Curriculum Vitae of the 2nd Respondent as well as GENERAL FORM OF AFFIDAVIT duly sworn to by the 2nd respondent at the High Court of the Federal Capital Territory, Abuja, along with copies of his Membership Card of the 3rd Respondent and Voter Card.
“The information submitted to the 1st respondent (INEC) by the 2nd respondent (Buhari) is false and of a fundamental nature in aid of his education qualification, notwithstanding that he had declared in the said sworn affidavit as follows: ‘I hereby declare that all the answers, facts and particulars I have given in this Form, are true and correct and I have to the best of my knowledge, fulfilled all the requirements for qualifications for the office I am seeking to be elected’.”
They stated that the educational institutions Buhari “claimed to have attended and the certificates presented by him namely, Elementary School Daura and Mai Aduaa between 1948 and 1952, Middle School Katsina between 1953 and 1956 and Katsina Provincial College (now Government College, Katsina) between 1956 to 1961 and mentioned by the 2nd respondent in his curriculum vitae attached to Form CF 001, were not in existence as of those mentioned dates.”
They added, “The 2nd respondent in Form CF 001 filled and submitted by him to the 1st Respondent at Paragraph C, Column 2, Page 3, under SECONDARY, wrote “WASC,” thereby falsely claiming that qualification whereas there was no qualification known as WASC as of 1961.
“The petitioners contend that the 2nd Respondent was, at the material time, not qualified to contest election for the exalted office of President of the Federal Republic of Nigeria.
“The petitioners further aver that all votes purportedly cast for the 2nd and 3rd Respondents on 23rd February, 2019 during the Presidential Election and as subsequently declared by the 1st Respondent on February 27, 2019 are wasted votes in that the 2nd Respondent was not qualified to contest the said election in the first place or at all.”
Names of 21 Senior Advocates of Nigeria and 18 other lawyers appeared on the petition.
The legal team is led by Mr Livy Uzoukwu (SAN).
They sought among their five main prayers, that the tribunal should determine that Buhari “was not duly elected by a majority of lawful votes cast in the said election” and therefore his declaration and return by INEC “as the President of Nigeria is unlawful, undue, null, void and of no effect”.
They also prayed that Atiku having been “duly and validly elected” ought to be “returned as President of Nigeria, having polled the highest number of lawful votes cast at the election to the office of the President of Nigeria held on February 23, 2019 and having satisfied the constitutional requirements for the said election.
They sought “an order directing the 1st respondent (INEC) to issue a Certificate of Return to the 1st petitioner (Atiku) as the duly elected President of Nigeria”.
They also asked the tribunal to rule that Buhari “was at the time of the election not qualified to contest the said election”, and that he “submitted to the Commission affidavit containing false information of a fundamental nature in aid of his qualification for the said election”.
However, they sought as their alternative prayer, “that the election to the office of the President of Nigeria held on February 23, 2019 be nullified and a fresh election ordered.”
The petitioners are relying on 50 sets of documents which they, in the petition, gave INEC the notice to produce the original copies of those in its custody.
Some of the documents are, “INEC Nomination Form CF001 of the 2nd respondent (Buhari); all INEC result sheets;(Form EC8 Series), EC8A, EC8B, EC8C, EC8D and EC8E – Certificate of Return; PDP Party Membership Cards; INEC Voter Cards; all witnesses’ party membership cards; and all Witnesses’ Voter Cards.”
The petitioners also sought to rely on, “the circulars/corrigenda/manuals issued by INEC for the conduct of the Presidential Election held on 23/2/2019; Polling Unit materials checklist; summary of total registered voters on units’ basis; summary of PVCs collected on units’ basis; Voter Registers and letters of complaints over irregularities and malpractices during the election addressed to the INEC/Police/other relevant agencies/institutions.”
They also sought to rely on “security reports relating to the election video/audio recordings/DVD/CD relating to the Election; Election Observers’ or Observers’ Reports; Newspaper/Television/ Radio reports and news; appointment letters and tags of PDP agents; expert reports and analysis; and photographs and GSM and other phone outputs”.
North-Central APC Reps want speakership

Members of the House of Representatives on the platform of the All Progressives Congress from the North-Central have called on the ruling party to zone the position of the speaker to their area.
The North-Central APC lawmakers made the demand at a press conference after the plenary on Tuesday.
It was observed that Mr John Dyegh, who addressed journalists, was accompanied by only four others, while he signed the speech “for and on behalf of the APC North-Central Caucus.”
Dyegh said, “We, the members of the North-Central Caucus of the All Progressives Congress in the House of Representatives, called this briefing to express our position with respect to the leadership position of the ninth Assembly.
“You are not unaware of the interest the issue of the leadership of the next assembly has generated in the public space. We want to use this medium to acknowledge the supremacy of our party, the APC, in addressing the issue of zoning of positions in an equitable, just and fair manner that will foster unity and cordial relations among members of our party and our colleagues from the other political divides.
“We are confident of the ability and capacity of the national leadership of the APC to do what is right to all in order to advance national cohesion, balance of power and federal character.
“It is in this regard that we humbly wish to appeal to our great party, the APC, to strongly consider the North-Central geopolitical zone for the position of the Speaker of the House of Representatives in the 9th Assembly.”
Listing the reasons for the demand, the lawmaker said it would satisfy and advance the cause of equity “since the North-West and the South-West already have the president and vice-president positions, respectively.”
He added that apart from the North-West and the North-East, the North-Central “delivered handsomely for the party in the general elections and as such needs to be rewarded for the hard work and loyalty.”
Dyegh added, “The need to ensure balance and spread between and among the six geopolitical zones has made it imperative to give prime consideration to the North-Central zone to produce the position of the speaker. Being the zone with delicate and peculiar location and challenges within the federation, it is of utmost importance to carry us along in the hierarchy of power distribution in the country as this will in no small measure, help in stabilising the polity.”
Meanwhile, some politicians in the camp of the Majority Leader, Mr Femi Gbajabiamila, have faulted the claims by those who believe that his emergence as speaker will further widen the political clout of a national leader of the APC, Asiwaju Bola Tinubu.
The anti-Tinubu lawmakers had alleged that the former Lagos State governor was nursing presidential ambition in 2023 and they would oppose the emergence of his strong ally, Gbajabiamila, as the speaker.
One of them said, “There are people who feel that Asiwaju will be president in 2023. Therefore those who are aspiring for the same office will not want Gbajabiamila to become speaker because that will oil the political machine of Asiwaju. It is not that Gbajabiamila has annoyed these members for any reason, no; he is just carrying the burden of someone else. This is not his fault.”
A source in Gbajabiamila’s camp, however, dismissed the claims as untrue, arguing that there were also members of the chamber who were aggrieved with the current Speaker, Yakubu Dogara.
The source, who spoke on the condition of anonymity, said, “We are also working on the political front. Someone said he was not friendly, another person said he didn’t do some things. We also know some outgoing members who supported Gbajabiamila in 2015 but are now bitter because they lost their re-election bid.
The source added, “They lost re-election in their constituencies, is Gbajabiamila responsible for that too? What if the Leader also lost his re-election bid back in Surulere in Lagos? It is being fuelled by some northern lawmakers, alleging that Tinubu wants to be President in 2023 and if Gbajabiamila is the Speaker, it will give him a lot of advantages. It is a dummy that they are selling.”
Stating that Gbajabiamila could not have been able to do much for his loyalists as the Majority Leader and not the Speaker, he urged them to remain loyal, adding that they would be rewarded after Gbajabiamila must have become the speaker.
“There are also those who supported Dogara in 2015 but are now disappointed and are not happy with how the Speaker managed some committees. We know all those things,” he added.
In a related development, some key leaders of the opposition Peoples Democratic Party in the Senate are already reaching out to the newly-elected members of the APC with a view to forming an alliance that would produce a ‘friendly’ Senate President.
A ranking PDP senator from the South-East geopolitical zone told The PUNCH on condition of anonymity that some key opposition senators were already talking to a leading aspirant for the top job on how to back his aspiration.
Those in the race for the Senate President’s seat are, senators Ahmad Lawan (Yobe), Ali Ndume (Borno), Danjuma Goje (Gombe) and Abdullahi Adamu (Nasarawa).
Presently, 63 members have been elected on the platform of the APC, 42 from the PDP while the Young People’s Party secured a seat.
The Independent National Electoral Commission had yet to declare two seats while Governor Rochas Okorocha had yet to collect his certificate of return.
The calculation of the opposition senators, according to the source, is that the PDP with a block vote of 42 would ensure victory for any candidate that they decide to support.
He said, “Apart from ensuring that our members are not rendered redundant in the 9th Senate, we would not be happy to have a rubber stamp leader dance to the whims and caprices of the executive.
“We are not saying that we should be confrontational on all issues but at least, we deserve a leader who will guarantee the independence of the legislature. We achieved that at both chambers in 2015 and we can repeat the same again.”
The Deputy Chief Majority Whip, Senator Francis Alimikhena and the Senate spokesperson, Senator Sabi Abdullahi, declined comments when contacted to speak on the issue.

During the election campaign rallies, it was a trend for Nigerian politicians especially those from the All Progressives Congress (APC) to do the ‘Shoki’ dance. 3. Using commercial motorcycle:
While campaigning in 2014, the governorship candidate of the Peoples Democratic Party (PDP) in Osun state, Iyiola Omisore had been spotted on a motorcycle (okada). This however did not go down well with commercial motorcyclists, popularly called Okada riders. They described the photograph as a fake, saying he was trying to fake identifying with the people.

PDP, Atiku assemble 400 witnesses against Buhari’s victory
The Peoples Democratic Party and its presidential candidate in the February 23, 2019 presidential election, Alhaji Atiku Abubakar, said on Monday that they had assembled over 400 witnesses to testify at the Presidential Election Petitions Tribunal, where they would challenge the victory of President Muhammadu Buhari and his All Progressives Congress’ victory at the poll.
They spoke through the National Legal Adviser of the PDP, Mr Emmanuel Enoidem, on the premises of the Court of Appeal in Abuja, venue of the tribunal where they filed their petition on Monday.
Enoidem spoke to journalists after a joint petition of the party and its presidential candidate was filed at the tribunal’s secretariat.
As of 7.40pm on Monday, the last set of lawyers representing petitioners was just leaving the secretariat.
Enoidem, who said the petitioners would be represented by over 20 Senior Advocates of Nigeria, noted that the last day for the filing of the petition from the date the results of the election were announced was Tuesday.
The petitioners had 21 days from the date the final results of the presidential election were announced on February 27, 2019.
Enoidem said, “The last day for the petition was actually tomorrow (Tuesday)but we decided to file it today (Monday). We asked that our candidate who won the election massively across the country be declared the winner of that election.
“In the alternative, we also asked that the results be set aside on the grounds of irregularities which were very apparent across the country.
“We have a pool of 20 SANs, who are tested in election petitions matters, and other senior lawyers who are also working with them. So we are very ready for the petition. The petition is well packaged.
“The depositions are well put together. More than 400 witnesses are going to testify in this petition. Nigerians are at home with what happened on February in this country, the sham they called election.
“Of course, we are going to re-present the facts to Nigerians as the facts are already in the domains on Nigerians. We are not going to manufacture facts.”
While the order of the tribunal permitting the petitioners to have access to the electoral materials used for the conduct of the election had yet to be enforced, Enoidem said on Monday that his party and its candidates were able to beat the time in filing the petition.
Also speaking, a member of the legal team of the petitioners, Chief Mike Ozekhome (SAN), said the petition was “strong, solid and unassailable.”
He said with only one day to the deadline for filing of the petition, the late filing was due to lack of cooperation from the Independent National Electoral Commission in terms of getting access to the electoral materials.
He said, “We have up to tomorrow (Tuesday), to file but we have been having some challenges from INEC itself in terms of assessing materials used during the elections. But I believe we will get there.
“Our petition is quite solid, strong unassailable and we believe that by the grace of God the true keeper and owner of the mandate will have his mandate given to him.”
